A. Permitted Uses

You may use this website to:

  • Learn about IYTM programs and mission
  • Make charitable donations
  • Register for programs or events
  • Volunteer or apply for positions

B. Prohibited Conduct

You agree NOT to:

Maximum Liability

  • The amount you paid to IYTM in the 12 months preceding the claim, OR
  • $100 (if you paid nothing)

Note: Some jurisdictions do not permit liability limitations for gross negligence or willful misconduct. This clause applies to the fullest extent permitted by applicable law.

5. Donation Policy & Tax Deductibility

A. Tax-Exempt Status

If You Teach Me Inc is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. EIN: 33-2088658

Contributions are tax-deductible to the full extent allowed by law under IRC Section 170(c).

B. Donation Acceptance

  • We accept donations in any legal form (cash, check, credit card, wire transfer, in-kind gifts)
  • Acceptance of a donation does not obligate us to use funds for a donor-requested purpose
  • Restricted gifts are accepted only if consistent with our mission
  • We reserve the right to decline any donation without explanation

C. Restricted vs. Unrestricted Gifts

Unrestricted Donations: We may use for any organizational purpose consistent with our mission.

Restricted Donations: You may designate a specific purpose (e.g., "for scholarship program").

If a restricted gift cannot be used as intended, we may:

  • Seek your permission to use for closest organizational purpose
  • Hold in restricted fund pending future use
  • Return donation (rare circumstances)

D. Online Donation Terms

  • No Refunds: Donations are generally non-refundable
  • Exceptions: Duplicate/erroneous transactions (full refund) or written request within 30 days (refund minus processing fees)
  • Payment Security: We use PCI-compliant payment processors; your payment information is encrypted
  • Card Storage: We do NOT retain credit card numbers
  • Recurring Donations: Auto-renew unless you cancel (instructions provided in confirmation email)

E. Tax Receipts & Substantiation

  • Donations of $250 or more receive written substantiation within 30 days
  • Donations under $250 acknowledged by email or letter
  • Receipts include: Amount, date, tax ID, description, fair market value (if applicable)
  • Quid Pro Quo Donations: If you receive goods/services in exchange, receipt will state fair market value and tax-deductible portion

F. Donor Privacy (North Carolina Law)

Your donation information is protected under the North Carolina Personal Privacy Protection Act (Session Law 2025-79), effective December 1, 2025.

  • We do NOT sell donor information
  • We do NOT share donor lists with third parties (except required legal disclosure)
  • We do NOT provide donor information to government agencies
  • Your name may appear in annual report UNLESS you opt out

G. Tax Responsibility

Donor is responsible for IRS compliance. We provide written substantiation; consult a tax professional for deductibility questions. We are not responsible for tax consequences of donations. Our donation receipt is not tax advice.

6. Intellectual Property Rights

A. Our Content

All content on this website (text, images, graphics, logos, videos, design, educational materials, program descriptions) is the property of If You Teach Me Inc or licensed to us.

License to You: We grant you a limited, non-exclusive, non-transferable license to access and use our content for personal, non-commercial purposes only.

You may NOT:

  • Copy, reproduce, or distribute content without written permission
  • Modify, create derivative works, or reverse engineer content
  • Use content for commercial purposes

WE ARE NOT RESPONSIBLE FOR:

8. Program Participation & Liability Release

A. Program Disclaimer

While IYTM makes reasonable efforts to provide quality programs and services, we do NOT guarantee:

  • Specific results or outcomes from program participation
  • Participant safety in all circumstances (inherent risks exist)
  • Accuracy of all instructor or volunteer information
  • Program availability (may be limited by capacity or circumstances)

B. Assumption of Risk

By participating in IYTM programs or events, you (or parent/guardian on behalf of minor participant) acknowledge:

  • Risk of injury or harm exists in program activities
  • IYTM has informed you of risks
  • Participant has physical and mental ability to safely participate
  • You assume all risks of participation

C. Release of Liability

You (or parent/guardian) release If You Teach Me Inc, its officers, directors, employees, and volunteers from liability for:

  • Injury or death arising from program participation
  • Property damage
  • Medical expenses
  • Any other claims related to participation

EXCEPT: Gross negligence, willful misconduct, or violation of law.

D. Code of Conduct

All participants, volunteers, and staff must:

  • Treat others with respect and dignity
  • Refrain from harassment, discrimination, or bullying
  • Follow safety guidelines and staff instructions
  • Respect property and materials

Violations may result in immediate removal from programs without refund.

9. Indemnification

You agree to indemnify, defend, and hold harmless If You Teach Me Inc, its officers, directors, employees, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your use of the website or services
  • Your violation of any applicable law
  • Your infringement of third-party rights (intellectual property, privacy, etc.)
  • Content you submit or transmit through the website

10. Governing Law & Dispute Resolution

A. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina.

B. Dispute Resolution

In the event of a dispute arising from these Terms or your use of our services:

  1. Negotiation: Parties agree to first attempt to resolve disputes through good-faith negotiation
  2. Mediation: If unresolved after 30 days, parties may pursue mediation
  3. Arbitration: If mediation fails, disputes shall be subject to binding arbitration under American Arbitration Association (AAA) rules in Mecklenburg County, North Carolina
  4. Legal Fees: Each party bears own legal fees unless arbitrator awards otherwise

Exception: We may seek injunctive relief in court for intellectual property infringement or breach of confidentiality without arbitration.

11. General Provisions

A. Entire Agreement

These Terms, combined with our Privacy Policy and Donation Policy, constitute the entire agreement between you and If You Teach Me Inc regarding use of our website and services.

B. Severability

If any provision of these Terms is found invalid or unenforceable by a court, that provision shall be severed and the remaining provisions shall continue in full force and effect.

C. Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

D. Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

E. Updates to Terms

We may update these Terms from time to time. Changes are effective upon posting. Material changes will be communicated via email to registered users and posted prominently on our website for 30 days.
